Terms and Conditions for Our Tuition Services

1. Acceptance of Terms

By registering for, accessing, or using the HM Tutor platform (the “Service”), you confirm that you have read, understood, and agree to these Terms and Conditions (“Terms”). If you do not agree, you must discontinue use of the Service. These Terms form a legally binding agreement between you and HM Tutor (“we,” “us,” or “our”).

2. Description of the Service

HM Tutor provides an online platform offering tuition, courses, and professional learning tools. Features include collaborative study, course content, file sharing, notifications, chat, and scheduling tools for educators and learners.

3. Privacy and Security

We prioritize your privacy and comply with the Protection of Personal Information Act, 2013 (POPIA). We do not and will never integrate third-party advertising or sell your personal data. Your data is encrypted in transit and at rest, and access is strictly limited to authorized personnel for service operation purposes only.

4. User Accounts

You must create an account to access most features. You are responsible for maintaining accurate information, securing your credentials, and any actions performed under your account. Notify us immediately if you suspect unauthorized use.

5. User Content and License

You retain ownership of any content you upload (“User Content”). By submitting content, you grant us a limited, non-exclusive license to host, display, and distribute it solely for operating the Service. We do not claim ownership of your work or educational materials.

6. Prohibited Conduct

You agree not to:

  • • Post unlawful, defamatory, abusive, or infringing content.
  • • Attempt to breach, disable, or circumvent security features of the Service.
  • • Misrepresent your identity or affiliation.
  • • Use the Service for commercial advertising or solicitation without written permission.

7. Payment and Refunds

Paid courses and subscriptions must be settled in full before access is granted. Refunds, if applicable, are processed at our sole discretion and subject to any refund policy published at the time of purchase.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, misuse the platform, or threaten security. Termination may occur without prior notice to protect other users and the platform’s integrity.

9. No Ads and No Sale of Data

We do not display advertisements or sell your personal information to third parties. Our business model is entirely based on course sales and subscriptions.

10. Limitation of Liability

The Service is provided “AS IS” and “AS AVAILABLE.” To the extent permitted by South African law, HM Tutor shall not be liable for indirect, incidental, or consequential damages resulting from your use of the Service.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of South African courts.

12. Amendments to Terms

We may update these Terms from time to time to reflect service changes or legal requirements. Material updates will be communicated via email or platform notices. Continued use constitutes acceptance of updated Terms.
