1. Acceptance of Terms
By enrolling in our tuition services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not enroll or use our services. These terms constitute a legally binding agreement between you and our tuition institute.
2. Tuition Fees
Tuition for Grade 4 to 12 is billed at R200 per hour per subject. These rates are non-negotiable and are subject to change at our discretion, with prior notice provided to current students and parents. Any changes to tuition fees will be effective from the next billing cycle.
3. Payment Schedule
Tuition fees must be paid in full at the beginning of the month or before the learner commences their tuition sessions. Failure to make timely payments will result in immediate suspension of services until payment is received. Continued failure to pay may result in termination of the contract without any refunds for the remaining lessons in the month.
4. Fee Calculation
The total monthly fee will be calculated based on the number of hours required for all selected subjects. A detailed breakdown of the required hours and corresponding fees will be provided at the beginning of each month. Parents or guardians are responsible for ensuring the accuracy of the selected subjects and corresponding hours.
5. Missed Lessons
In the event of a missed lesson without a valid reason (e.g., sickness or other justifiable circumstances), the fees for that lesson will be forfeited. Refunds or replacement lessons will not be provided under any circumstances. It is the responsibility of the student and their parents or guardians to ensure attendance at all scheduled lessons. Persistent absenteeism may result in removal from the program.
6. Waiting List Policy
We maintain a waiting list of students who wish to enroll in our services. It is imperative to honor scheduled lessons, as last-minute cancellations impact both the tutor and the establishment. Failure to attend scheduled lessons without valid reasons may result in removal from the program and loss of the reserved spot for tuition services. Re-enrollment will require joining the waiting list again.
7. Commencement of Tuition
Tuition sessions will commence only after full payment of tuition fees. Failure to comply with this requirement will lead to the immediate replacement of the learner and termination of the contract. No exceptions will be made. It is the responsibility of the parents or guardians to ensure timely payments to avoid disruption of services.
8. Termination and Refunds
We reserve the right to terminate tuition services at our discretion if there is a breach of these terms, non-payment of fees, or if the student's behavior is deemed unacceptable. In such cases, no refunds will be provided for any remaining lessons in the month. If a parent or guardian wishes to terminate the contract, they must provide one month's notice in writing. Fees for the remaining lessons in the month will not be refunded.
9. Student Conduct and Discipline
Students are expected to conduct themselves in a respectful and disciplined manner during tuition sessions. Any form of disruptive behavior, disrespect towards tutors or peers, or violation of institute rules will not be tolerated. Repeated offenses may result in suspension or termination of tuition services without any refunds.
10. Liability
We shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with our tuition services. Our total liability for any claims arising under these terms shall not exceed the total amount of fees paid by the student or their guardians in the three months preceding the event giving rise to the claim. Parents and guardians agree to indemnify and hold harmless our institute, tutors, and staff from any claims, damages, or liabilities arising from the student's participation in our services.
11. Confidentiality
We are committed to protecting the privacy and confidentiality of our students. All personal information provided to us will be kept confidential and used solely for the purpose of providing tuition services. We will not disclose any personal information to third parties without prior consent, except where required by law. Any breach of confidentiality by the student or their guardians may result in termination of services.
12. Intellectual Property
All materials, content, and resources provided during tuition sessions are the intellectual property of our institute and are protected by copyright laws. Students and their guardians agree not to reproduce, distribute, or share these materials without prior written consent from our institute. Unauthorized use of our intellectual property will result in legal action.
13. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting on our website. It is the responsibility of the student and their guardians to review these terms regularly. Continued use of our services after any changes constitutes acceptance of the new terms. Failure to comply with the updated terms may result in termination of services.
14. Force Majeure
We shall not be liable for any failure to perform our obligations under these terms due to events beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, strikes, and other unforeseen events. In such cases, we will make reasonable efforts to resume services as soon as possible.
15. Governing Law
These Terms of Service and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of South Africa. Any legal actions or proceedings related to these terms shall be brought exclusively in the courts of South Africa. Parents and guardians agree to submit to the jurisdiction of these courts.
16. Entire Agreement
These Terms of Service constitute the entire agreement between you and our tuition institute regarding the use of our services. Any other agreements, representations, or warranties not contained herein shall be of no force or effect. Any amendments to these terms must be in writing and signed by an authorized representative of our institute.
17. Severability
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the extent necessary to make it valid and enforceable while preserving the original intent of the provision.
18. Waiver
Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these terms will be effective only if in writing and signed by an authorized representative of our institute.
